Welcome to Gateway Financial Services. These Terms and Conditions govern your access to and use of our services, including assistance with job applications and visa applications (the “Services”).
By using our Services or submitting an inquiry, you agree to these Terms. If you do not agree, do not use our Services.
1. Services Provided
- Gateway provides support and guidance to help you with:
- Job application preparation, including resume/CV and application support; and/or
- Visa application assistance, including document checklist guidance, form preparation support, and organization of your application materials.
- We do not act as an immigration authority, employer, or government agency.
- Our Services are designed to help you prepare and submit application materials correctly, but we cannot control outcomes determined by employers, embassies/consulates, or immigration authorities.
2. No Guarantee of Approval or Employment
- You acknowledge that:
- Visa approvals are solely determined by the relevant immigration authority.
- Employment decisions are solely determined by the employer.
- Gateway does not guarantee:
- visa issuance,
- approval,
- work authorization,
- interview invitations,
- job offers,
- or employment.
- Any timelines provided are estimates only and may change based on third-party processing times.
3. Client Responsibilities
- You must provide accurate, complete, and up-to-date information and documents.
- You agree not to submit false, misleading, or fraudulent information.
- You are responsible for reviewing all documents and statements prepared or assisted by Gateway before submission.
- If you fail to provide required information or provide inaccurate documents, Gateway is not responsible for delays or unfavorable outcomes.
4. Scope of Assistance
Unless explicitly stated in writing, Gateway support may be limited to:
- guidance on requirements and document organization,
- assistance with application forms and drafting support,
- review of documents you provide,
- preparation checklists and instructions.
Any additional services (including representation or submission on your behalf) must be specified in a written agreement or invoice.
5. Fees and Payment Terms
- Fees for Services are set out in a proposal, invoice, service package, or quotation.
- Payment terms may include deposits, milestone payments, or full payment before work begins (as stated in your invoice).
- You agree to pay all fees in full on the due dates specified.
- Late payments may result in suspension of Services until payment is received.
- Refunds (if applicable) will be handled only according to the refund policy provided at the time of purchase or as stated in the invoice/package terms.
6. Cancellation and Rescheduling
- You may cancel or reschedule services according to the policy stated in your invoice or package.
- If work has already started, Gateway may charge for work completed up to the cancellation date.
- You are responsible for any non-refundable third-party costs (if applicable).
7. Use of Documents and Client Materials
- You retain ownership of your original documents and information.
- By providing documents to Gateway, you grant us the right to use, process, and store them solely to perform the Services.
- Where required, Gateway may use third-party tools (e.g., secure storage or document management systems) to support service delivery.
8. Confidentiality
- Gateway will handle your information in a confidential manner, subject to:
- legal requirements,
- compliance obligations,
- and information necessary to perform the Services (e.g., communication with service providers).
- Confidentiality does not apply to information that:
- becomes public through no breach by Gateway,
- was lawfully known by Gateway prior to receipt,
- is independently developed by Gateway without use of your information,
- is required to be disclosed by law.
9. Communications and Response Times
- You agree that communication occurs through the channels you provide (email/phone/portal).
- Gateway will make reasonable efforts to respond, but response times are estimates and depend on workload, document completeness, and external processing timelines.
10. Limitation of Liability
To the maximum extent permitted by law:
- Gateway will not be liable for indirect, incidental, special, consequential, or punitive damages.
- Gateway’s total liability arising from or related to these Terms and the Services is limited to the amount you paid to Gateway for the specific Services giving rise to the claim.
- Gateway is not liable for:
- decisions made by immigration authorities or employers,
- delays due to third parties (couriers, government processing, employer HR),
- losses arising from incorrect information provided by the client,
- technical issues outside Gateway’s control.
11. Indemnification
You agree to indemnify and hold harmless Gateway, its owners, employees, and agents from claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:
- inaccurate or incomplete information you provided,
- your breach of these Terms,
- your violation of applicable laws or regulations,
- misuse of the Services.
12. Intellectual Property
- All materials provided by Gateway (templates, checklists, guidance content, drafts, and written resources) are owned by Gateway or used with permission and are protected by intellectual property laws.
- You may use Gateway materials solely for your own application preparation in connection with the Services.
- You may not reproduce, distribute, sell, or publicly display Gateway content without written permission.
13. Third-Party Services and Links
- The Services may involve or reference third-party platforms, websites, or services (e.g., government portals).
- Gateway is not responsible for third-party content, availability, or policies.
- You access third-party websites at your own risk.
14. Prohibited Conduct
You agree not to:
- use the Services for illegal purposes,
- submit fraudulent documentation,
- attempt to misuse or gain unauthorized access to our systems,
- interfere with our operations or security,
- harass, threaten, or abuse our staff.
15. Termination
- Gateway may suspend or terminate services if you breach these Terms, fail to provide required information, or engage in misconduct.
- If terminated, fees paid may not be refundable depending on work performed and the applicable package terms.
16. Governing Law
